 The hereby Terms and Conditions, Privacy Policy and Sales ( terms and conditions further on) sets out the conditions of access and use of the Web site www.artsfite.com (further on, ARTSFITÉ), which FITÉ offers people who use its Web Site in order to provide them information about products and services, as well as marketing paintings and other artworks.

The Web site was thought, created and designed for ARTSFITÉ, in order to inform people and allow access to the information within it, taking into account the restrictions and limits set by the hereby Terms and conditions.

The simple use of the Web site gives the visitor the status of user. All users who access ARTSFITÉ agree with each condition contained in these Terms and Conditions, at the moment the visitor uses the Web site, as long as it applies to them.

The members state that they are aware of the Terms and Conditions set out and hereby they accept them without any reservations or exceptions.

2. LICENCE TO USE THE SITE

Conditions of access and use

Through the Web site ARTSFITÉ, any user will have free access to the information it contains.

The conditions of access to ARTSFITÉ are subject to to the actual legal dispostions at the moment of access as well as the principles of good faith and legal use made by the user. Any use that may cause damage or harm to the Web site, FITÉ or any third party is totally and specifically prohibited.

The Web site doesn’t require any subscription to simply visit, have access or use it.

Only members can buy the products and services stated in ARTSFITÉ, with the features and conditions specified on the Web site.

To become a Member of ARTSFITÉ you must register and accept the Terms and Conditions.To log in, Members must type their e-mail address and password (at least 5 characters are required).

The password is personal and cannot be transferred. It is not allowed to be transferred, even temporarly to third parties. Therefore, Members commit themselves to use the site conscientiously and to keep their password secret, assuming the responsabilities otherwise.

If Members are aware or suspect that somebody is using their password, they will have to change it immediately, as it is stated on the Web site, and notify  ARTSFITÉ within 24 hours.

Acceptable use

The main purpose of this Web site is to offer an information service -content of the Web site- and to market products and services. Therefore all users must respect the here mentioned information and the transactions that it may provide.

In any case, the users commit themselves not to do any malicoius or intentional harm that may damage the image of the Web site or alter it, such as introducing or spreading viruses or other harmful elements that may cause unauthorized changes in the contents of the Web site, integrated Systems or in the electronic documents and files stored in the computer system. Consequently, users will have to give a compensation for the damages caused to FITÉ and the third parties affected if the Terms and conditions are not respected.

The users commit to use the Web site according to the law, moral and public order, including the prohibition to copy, reproduce, distribute, transfer, transform or modify the contents whithout any previous written agreement from ESTEVE APARICIO FITÉ or any delegate.

On this matter, FITÉ is not responsible for any kind of errors, viruses or other harmful elements introduced by third parties.

3. ARTSFITÉ’S RIGHTS AND OBLIGATIONS

ARTSFITÉ will only and exclusively be responsible for the services that it offers and for the contents it created.

ARTSFITÉ commits itself to fulfill all the requirements stipulated, related to the intellectual, industrial and other similar property rights.

ARTSFITÉ commits itslef to guarantee the security and privacy of the Communications. It will not be responsible if the relevant security measures it has set are violated by external agents.

Some Tools such as links, among others, which allow access to other sites are available for the Users. However, ARTSFITÉ won’t under any circumstances be responsible for the damages caused while accessing third party’s services, through connections or Web sites of the links proposed or for the reliability of them.  The function of the links that appear in ARTSFITÉ is only to give the Users other sources of Internet information, where they will have the possibility to expand the information and/or services that ARTSFITÉ offers. The latter, won’t in any case be responsible for the results found on these sites or for the consequences that may arise from the Users’ access to these sites.

ARTSFITÉ won’t be responsible not even indirectly or subsidiarily, for any contents, information, opinions or any kind of statements Users, third parties or entities may post on ARTSFITÉ.

ARTSFITÉ reserves the right to interrupt the access to the Web site as well as any or all of the services it offers without any kind of notice, for technical, security, control or maintenance reasons or for any failure in power supply or any other justified cause. ARTSFITÉ also reserves the right to modify, at any time, the Web site appearance and settings, as well as the hereby Terms and Conditions.

ARTSFITÉ won’t be responsible if the service is interrupted, slowed down, or if there are any errors or if sites do not work properly, or more generally if there are any other  drawbacks that  cannot be solved or that are fraudulently caused by Users or Members, and/or acts of nature and force majeure. Without prejudice to the article 1105 of the  “Código Civil”, the term force majeure will also include, furthermore and to the effects of the hereby Terms and Conditions, all the events that may occur independently from ARTSFITÉ, such as: third parties, network operator or service companies failure, government acts, lack of access to third parties’ networks, Public Authorities acts or omitions, and other results of natural phenomenons, power cut etc. and possible hackers or third parties specialized in the security and integrity of the computer system, if ARTSFITÉ has taken the reasonable security measures according to technology will not assume responsbility for direct or indirect damages, ensuing damage and loss of profits.

4. MODIFICATION OF THE SALES CONDITIONS

ARTSFITÉ reserves the right to modify the Sales Conditions without notice. Contents and services may change, be deleted or added and the way they appear on the Web site may also change.

5. JURISDICTION

For any interpratation or litigation issues that may be raised the Spanish and Catalan laws will be applied. In case of a controversy, both partiesrenounce the right to any other Courts that may apply, and submit to the Courts and Tribunals in the city of Barcelona (Spain).
